PRESENTATION Chat Moçambique - a service supplied by: ClubeNet Limited The present agreement establishes the obligatory terms that are going to govern the legal relationship between the site Chat Moçambique and its Members. Once these terms are violated, this contract will automatically terminate causing legal action in case of injury toward provider ´s service and/ or third parties. If this contract is terminated exclusively by the user ´s fault, there will be no refunded amount of paid plans, should there be a member ´s plan envolved. II. SERVICE USED : Chat Moçambique offers Internet services that will enable you to meet people and to maintain any kind of relashionship. The payment of the contracted service will have to be made by credit card. . Depending on the country the following othe payment options are avaible such as :Boleto Bancário, Bank Deposit, Bank Transfer, WesterUnion or by Post Office. The Chat Moçambique offers the following services After completing your registration of data, the User will be required to complete a mandatory form with their profile details in the «Register» area. After concluding this process, user will have access to most resources of our site. Basic members will be able to send per day : 10 kisses, 10 dedications, 10 flowers, send and receive flashes, read and reply to messages sent by plan members, send and receive text messages (SMS). All receivers can read and respond to the messages that are sent to them (limit of 600 messages) 2 Star members will be able to invite online chat with priority in attendance and can still formulate questions that will be replied and published in the «Consultation» area. In order to maintain your 2 star Plan membership, user will have to pay a monthly fee. These rates are available on the price table. Should any of the presented rates suffer any changes, the 2 star Plan member will be notified with 30 days in advance of the new fees. Should the 2 Star Member decide to cancel his/her plan, this process can be done at any time, but will mean that the user will lose the benefits of this category, being automatically included in the Basis User Category with any compensation. 3 and 4 Stars Members will have special privileges such as reading and replying to all messages received from other members regardless of their status (Basic or Star Membership). All receivers may read or reply to messages without any restrictions.. 3 and 4 Stars Members may call upon other member for on-line chats without any restriction, member will have priority to their queries and may even formulate their questions , that can be selected to be replied and published in the «Consultation» area and also giving these members a search priority. In order to keep your membership, the user must pay the periodical amount, that may be subject to the chosen plan: Tariffs can suffer adjustments throughout the year. 3 and 4 stars will be notified with 30 days of the new amount. In case of suspicion or strong indication of bad use of the services of site by some Users, the www.chatmocambique.com can take the profiles of air either temporarily or indefinitely, as well as refuse new registration of the User that has violated any of the clauses inserted in this Agreement. In this case, the Chat Moçambique is not obliged to reimburse any payments made by user. At the end of the registration process, the User should choose a password and a personal identification, that only they are responsible for and to keep it a secret from anybody else. The User is obliged to notify the siteChat Moçambique of any known unauthorised use of their password or account as well as any breach of security that may occur. The Members of the Chat Moçambique can create only one free profile , at this time the policy of the site does not authorise more than one free profile or basic for the same person. The terms of the promotion will be available for access in a prominent place. IV. REVOCATION OR CANCELLATION OF THE AGREEMENT OF UTILISATION. The present agreement of Utilisation can be revoked or suspended, without any previous warning, by Chat Moçambique, in case of violation of any clause of this contract in accordance with the Civil Code. In the case of annulment of the present agreement, due to any violation of the contract on the User ´s behalf, Chat Moçambique will not be obliged to reimburse any payments already made. V. AUTOMATIC RENEWAL When the star member accept the present agreement of Utilisation, user automatically authorizes the renewal of plan when this one expires through credit card details. This way, when you plan is about to expire, automatically there will be a renewal of your new plan and charged to your credit card. Should this facility not be of your preference, you can cancel the Star Plans and its subsequent renewals, just by sending an e-mail to our Technical Support team at any moment, but Chat Moçambique will not issue any reimbursement for the contracted period. ATTENTION: At the end of the contracted period, the User of the Star category will see their plan automatically renewed AND THE AMOUNT WILL BE REFERENT TO THE NEW PERIOD OF RENEWAL AND CHARGED TO YOUR CREDIT CARD. Payments can be made by Visa or Mastercard for site required services. Other forms of payment can be accepted according to country, such as Boleto Bancário, Bank transfer, Western Union or by Post office. VI. PRIVACY AND SECURITY POLICIES Chat Moçambique has a privacy and security policy that has the goal to protect their Members against any improper use by third parties. Chat Moçambique will not sell or share your personal information with third parties. Only by your expressed authorisation or through judicial authorisation will this information be divulged to the petitioning authority.Should User publish his information on the siteChat Moçambique to third parties, this will be to his entire responsiblity. To guarantee your security, it is recommended that you periodically change your password for personal use and that it is not transmitted to a third parties. Whenever Chat Moçambique sees fit, we may always require user for password in order to offer certain services or unblock system. Should you happen to forget your password, Chat Moçambique will send you via e-mail, the password you inserted when your registration was made. Chat Moçambique is not responsible for the dates and-or relationships that may occur between Members originating through services provided Chat Moçambique, is demanding that any judicial act committed by its Members, has the right to recuperate any judicial expenses against whoever caused them excercising a right to return. Chat Moçambique is not and cannot be held responsible, if a third party accesses information of the User because it was supplied to them, for example, password, nickname(username) or other similar information. VIII. OF THE COOKIES User, according to the present agreement, authorises and accepts that Chat Moçambique uses resourses such as «cookies» in order to offer a better and more personalised service. A Cookie represents a small amount of data,usually with an anonymous identity, sent to you by a site from the web and stored on the disc of your computer. User can configure the navegation software to accept all cookies, reject them or be notified when a cookie is sent. Should the user violate the terms of this agreement, profile will be removed indefinitely, without any refund of amounts paid by user. Damage caused to third parties by the use of false information by the User will be subject to legal action, as well as the right of refusal to the services of Clube Amizade User can only access services supplied by the site with the purpose to establish contact for personal relations. User will not be able to publish in profile racist or prejudiced text, he will not be able to violate the rights of children nor adolescents, he will not be able to advertise, transmit or provide any contents that is someone elses title nor can he violate copyrights or the rights of a third parties images, nor send any message containing viruses, or to advertise any kind paedophile characters, discriminatory, defamatory, abusive, profane, offensive or illegal. User will not be able to make advertising, or indulge politic opinions or request to any other User or third party to act in his name, unless by means of a power of attorney. User will not be able to use third parties to accomplish any actions, purchases, sales or cancellation of products or services through the site or any another form of communication offered by Chat Moçambique and Partners. User cannot transmit chain letters or spam to other Members. The User cannot use the site to divulge any illegal practise, abusive or any that can bring damage or detriment to a third party. User cannot include in his profile or disclose in Chat rooms any personal identification data or telephone numbers, mobile numbers, personal addresses or commercial addresses, surname, IMS, references or sexual suggestions including offensive language. The User is obliged to keep the confidentiality of personal information of other Members with whom they have been in contact with through the Chat Moçambique. You cannot divulge it in any other places. User will keep all the information supplied through Chat Moçambique as confidencial and is not authorized to publish them nor disclose them, without the express authorization of Chat Moçambique. User is entirely responsible for the contents of messages exchanged with other Members of the Clube Amizade. User cannot violate (intentionally or not) any current legal rule in the legal system, nor claim that he was not aware of the enforced rules. User will not be able to intervine in the system for any transmission of Chat Moçambique nor can make copy, reproduce, duplicate or to make use of the content of the site for any purposes. The User will be held responsible for any illegal practise committed. In the case that a violation of any of these regulations or any of the rules that are present in the Agreement of Use, Chat Moçambique can change or remove your profile IX.I. USER´S PROFILE XI. FROM THE COURT OF JUSTICE OF THE ELECTION: FROM THE COURT OF JUSTICE OF THE CONSUMER In compliance with current legislation, the forum to dissolve possible litigation that occur from this contract will be from the consumer. OF THE COPYRIGHT AND IMPROPER USE OF SITE Clubenet Limited. is the owner of all the rights to its brand, title and services offered through its site, and does not authorize any reproduction, transmission, exploration or any use, commercially or personally, of the contents of the site. The exploration, transmission, total or partial reproduction of the contents of the site or its improper use is subject to legal actions. XIII. FROM PHOTOGRAPHS AND FROM ATTACHED MATERIAL User cannot use a photo that is not his or her on their personal profile as this would result in a criminal charge due to false representation. When sending files and -or attachments these will be subject to analysis by the team of Chat Moçambique, therefore photos can be removed if they are not compatible with the established standards of our site. Each User is entirely responsible for all of the material or files that is sent to other Users through messages, prviate chat or in chat rooms, Text Message or WAP. The photos should be clear, update and in good condition. Photos cannot contain any kind of nudety, or semi-nude or exposure or other exposure of intimate parts of the body nor any explicit pornographic poses or illegal activities. «My Profile» space will only allow the members to exhibit his/her´s face.
